Terms of use
These Terms of Use are a binding contract between you and GoChamie, Inc. They govern your access to gochamie.com and the brands operated by GoChamie. Please read them carefully. They include an arbitration agreement and a class action waiver that affect how disputes are resolved. By creating an account or using our sites and services, you agree to these terms.
Definitions
GoChamie, we, us, and our mean GoChamie, Inc. Service means our websites, applications, and the brands we operate. Member, you, and your mean a person who accesses or uses the Service. Content means any text, photos, audio, video, and other materials posted or transmitted through the Service.
Eligibility
You must be at least 18 years old and able to form a binding contract to use our brands. You must not be barred from using the Service under the laws of the United States or any other applicable jurisdiction, you must not appear on any government sanctions or denied-party list, and you must not be a registered sex offender or have been convicted of a violent or sexual offense. Access by anyone under 18 is strictly prohibited.
Your account
You agree to provide accurate and complete information, to keep it current, to keep your login credentials secure, and to take responsibility for all activity on your account. One person may hold one account. Tell us immediately at support@gochamie.com if you believe your account has been compromised. We may require identity or age verification at sign-up or at any time, and we may restrict the account until verification is complete.
Acceptable use
You may not use our brands to harass, threaten, defraud, stalk, or impersonate others, to post unlawful, hateful, or sexually exploitative content, to solicit or advertise commercial sexual services, to facilitate trafficking or exploitation, to share another person's private or intimate content without consent, to send spam or unsolicited commercial messages, to transmit malicious code, to gain unauthorized access, or to interfere with the operation of the Service. You may not scrape, crawl, reverse engineer, decompile, or otherwise misuse our systems, and you may not use the Service to build a competing product or to train machine-learning models without our written permission.
Member conduct and safety
We have zero tolerance for human trafficking, sexual exploitation, and any conduct that endangers minors. We may, without prior notice, investigate, restrict, suspend, or permanently remove accounts, remove content, decline to provide the Service, preserve evidence, and report conduct to NCMEC and law enforcement. We do not conduct criminal background checks on members and cannot guarantee the identity, conduct, or intentions of any member, so you should exercise caution and follow our safety guidance. Content and license
You retain ownership of the Content you create. You grant GoChamie a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting and display), display, perform, and distribute your Content as needed to operate, secure, improve, and promote the Service. You represent that you have the rights necessary to grant this license and that your Content does not violate the law or the rights of others. We may remove or restrict Content that violates these terms or our policies.
Intellectual property
The brands, software, design, trademarks, logos, and content provided by GoChamie are owned by GoChamie or its licensors and are protected by US and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these terms. You may not reproduce, modify, or redistribute our materials without our written permission.
Copyright and DMCA
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act. If you believe your work has been used in a way that constitutes infringement, send a notice with the information required by 17 U.S.C. 512 to our designated agent at dmca@gochamie.com. We may remove allegedly infringing material and terminate repeat infringers.
Payments, subscriptions, and auto-renewal
Paid features and virtual items are billed according to the prices and terms shown at purchase. Subscriptions renew automatically for the same term at the then-current price unless you cancel before the renewal date through your account or app store. Where required by law, including the California Automatic Renewal Law, we disclose renewal terms clearly and provide an easy cancellation method. Virtual items have no cash value, are non-transferable, and are generally non-refundable once delivered, except where the law requires otherwise. Refunds are handled in line with our posted refund policy and applicable law, and purchases through an app store are subject to that store's policies.
Termination
We may suspend or terminate your access at any time, with or without notice, for violations of these terms or our policies, for risk to members or the public, or where necessary to comply with the law. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination will survive, including license grants for Content already shared, disclaimers, limitations of liability, indemnification, and dispute-resolution terms.
Disclaimers
The Service is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty of uninterrupted, secure, or error-free operation. We do not conduct criminal background checks on members and do not guarantee the conduct of any member or the outcome of any interaction or connection.
Limitation of liability
To the maximum extent permitted by law, GoChamie and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or the conduct of any third party or member. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim or one hundred US dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless GoChamie and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your use or misuse of the Service, your Content, your violation of these terms or applicable law, or your violation of the rights of any third party.
Dispute resolution, arbitration, and class action waiver
Please read this section carefully. Except for claims that may be brought in small-claims court and except for requests for injunctive relief to protect intellectual property or safety, you and GoChamie agree to resolve any dispute arising out of or relating to these terms or the Service through final and binding individual arbitration administered under the rules of a recognized US arbitration provider, governed by the Federal Arbitration Act. You and GoChamie waive the right to a jury trial and agree that claims may be brought only in an individual capacity and not as part of any class, collective, or representative action. You may opt out of arbitration by sending written notice to legal@gochamie.com within 30 days of first accepting these terms.
Governing law and venue
These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-laws rules. For any dispute not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, Florida, and you waive any objection to that venue.
Export controls and sanctions
You agree to comply with all applicable US export control and economic sanctions laws. You represent that you are not located in, and are not a national or resident of, a country or region subject to US embargo, and that you are not on any US government list of prohibited or restricted parties.
General terms
These terms, together with our policies referenced here, are the entire agreement between you and GoChamie regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We may provide notices to you electronically, and you consent to receive communications electronically.
Changes and contact
We may update these terms from time to time and will post the updated version with a new effective date. Material changes will be communicated where the law requires. Your continued use of the Service after changes take effect means you accept them. For questions, write to legal@gochamie.com.
